1. These General Terms and Conditions shall expressly govern the relationships that arise between RAFFUS - ALPHA INNOVATIVE PRODUCTS S.L., Calle Marc Castanyer, 2 - P.I. La Bòvila and tax registration number B-65166746 (hereafter, "GRAFFUS") and the third parties (hereafter, "Users") who register as users and /or purchase products through the official GRAFFUS website online store (http://www.e-graffus.com or http://www.e-graffus.es) (hereafter the "Store").
2. USER’S DUTIES
2.1 The User agrees to use the Store to purchase the Products and to use each of the services of the Store diligently under the law, morality, public order and provisions hereof. He must also prevent himself from using the said Products or services in any way that may prevent, damage or deteriorate the normal operation and use of the Store on the part of the Users or that may harm or cause damage to GRAFFUS goods and rights as well as to those corresponding to its suppliers, Users or, in general, any third party.
3. PRODUCTS AND PRICES
3.1 GRAFFUS reserves the right to decide, at all times, the Products that are offered to the Users through the Store. In particular, GRAFFUS may at any time add new Products to the ones offered or included in the Store, understanding that unless otherwise provided, such new Products shall be governed by the provisions of these General Terms and Conditions. Also, GRAFFUS reserves the right to stop providing or facilitating the access and use at any time and without prior notice of any of the different types of Products that are offered in the Store.
3.2 The Products included in the Store shall match, as truly as the website display technology allows, the Products effectively offered. The characteristics of the Products and their prices are displayed in the Store. The prices given in the Store are in Euros and do not include VAT, unless otherwise provided.
3.3 GRAFFUS can supply an installation manual together with the product, as well as components needed to carry out the installation. Nevertheless, users are responsible to decide the most suitable fixation system, according product dimensions and weight. GRAFFUS will not assume any responsibility regarding the installation nor direct or indirect damages caused by the fixation system.
3.4. GRAFFUS reserves the right to modify product prices at any time without previous notification.
4. PRODUCT PROCEDURE AND WAY OF PAYMENT
4.1 Within a maximum term of twenty-four (24) hours, GRAFFUS shall send an e-mail to the User confirming the purchase. This e-mail shall give a purchase reference code and shall give detail of the characteristics of the Product, its price, shipping & handling costs and those corresponding to the several options regarding the payment thereof to GRAFFUS.
4.2 The User who purchases a Product through the Store must make the payment using the payment options specifically detailed in the Store.
4.3 GRAFFUS shall file the electronic documents formalising the contract and shall send a copy to the User once the purchase has been made. The contract shall be drawn up in English.
4.4 The confirmation of the order sent by GRAFFUS is not valid a invoice, but it’s simply a purchase receipt. GRAFFUS shall send the invoice with the Product to which it refers.
5. WAIVER RIGHT
5.1 The User has the right to waive the purchase, for which he may contact GRAFFUS at the following e-mail address: pedidos@e.graffus.com and waive the purchase within a period of no more than one (1) working days as of the Product reception. GRAFFUS shall pay the Product direct return cost, which should be performed in accordance to the instructions that GRAFFUS gives to the User in reply to his waiver notification.

7. SHIPMENT SERVICE
7.1 GRAFFUS on-line shop is only selling inside European Union, therefore, all shipments will be inside this territory. Products purchased in the shop will be ship to the adress given by the User, once payment is confirmed, within thirty (30) days by law.
7.2 GRAFFUS shipment service, is carried out by several external well-known logitic operators. No shipments to post office boxes, hotels or any other non-permanent locations.
7.3 Shipment cost is not included in the product prices. During purchase process, User is informed about the exact cost of the shipment.
8. INDUSTRIAL AND INTELECTUAL PROPERTY
8.1 User accept that, all elements in the shop and any product, information and materials included to explain them, marks, structure, selection, order and presentation of contents, and the software used for this mean, are protected by GRAFFUS, or third parties, industrial and intelectual rights, and General Conditions do not give to the User any right different to the one specifically expressed in it.
8.2 Unless is authorized by GRAFFUS explicitly, or if it is the case, by a third party owing the rights, or in case it is legally permited, the User can not reproduce, transform, modify, disassembly, practise reverse-engineering, distribute, rent, share, or permit public access by any meaning, none of the elements referred in the previous paragraph. The User shall use these materials, elements and information accessed when using the Shop for the intended purposes of the shopping, and he/she is obliged not to carry out any comercial use, directly or indirectly, of the materials, elements and information obtanied through them.
8.3 User shall abstain from eluding or manipulate any technical device set by GRAFFUS o thirds in the Shop.
9. PERSONAL DATA PROTECTION
9.1 According Spanish law 15/99 LOPD, we inform your personal data and other information given through registration form, as well as the information coming from the purchase procedure, is included and kept on a file to be processed, owned by GRAFFUS, while no cancellation order is requested. This data will be used to carry out the purchase, give personalised attention regarding products and services bought and service improvement, as well as promoting own services and products and other companies related with GRAFFUS.
This data will be also used for GRAFFUS suppliers only to carry out the order. GRAFFUS will manage this data with as confidiential, using the data for the intended purposes, without giving it to other parties, except suppliers directly related with the process according current regulation.
User authorises expressly GRAFFUS the remission, even through electronic means, by GRAFFUS and entities mentioned before, of commercial communications, offers and promotion contests.
9.2 User can access, modify, or cancel his/her data contacting GRAFFUS at C/Marc Castanyer 2, Balenyà (Barcelona) 08550, or by e-mail to atencionalcliente@e-graffus.com, including a User ID document copy.
9.3. Data field with '*' character on the registration form are mandatory. If this basic personal data is not given, will not be possible to complete any purchase.
10. PASSWORDS
10.1 GRAFFUS will provide personal passwords to all Users registered on the internet site. These passwords will give access to services offered in the site. User is responsible for passwords confidenciality, and therefore assuming any damage o consequence caused by incorrect using of this informatino. For security reasons, passwords to access tthe internet services can be modified at any time by the User. User shall notify GRAFFUS immediately any non-authorised use of the password, as well as any non-authoritzed access by a third part.
11. COOKIES
11.1 GRAFFUS website is using cookies to improve its service, facilitate navigation, keep safety, verify User identity, facilitate access to personal preferences and follow shop use. Cookies are files installed in the computer hard disk or navigation program memory, on a default folder of the User computer operative system to identify it.
11.2 If User wants to avoid cookies are installed on the computer hard disk, navigation aplication have to be configured to do so. It is also possible to delete cookies directly on the computer. When cookies are disabled, service quality and speed can be reduced, and even loose access to some of the Shop services.
12. APPLICABLE LAW AND JURISDICTION
General conditions described above acording Spanish legislation. Any other disagreement arised from the interpretation or execution related with the validity, interpretation, following or resolution of this contract will be submitted to Vic City Court (Barcelona), with User jurisdiction renunciation, when law allow it.
